DISCRIPTION OF THE SITUATION Sierra Leone is a small Country with a population of approximately 5 million and square miles of 27,925.Its bordered with Guinea at the North East, Liberia at the South East and the Atlantic Ocean at the West. It is located at the west coast of Africa. Sierra Leone went through eleven years of brutal Civil conflict which lead to the destruction of lives and properties including human resources. This resulted to the high rate of illiteracy and idealness in the country today leading to the mass unemployed Youths. The conflict in Sierra Leone had a great impact on Children because their rights were systematically violated by all of the armed factions. They suffered the most cruel and inhuman experiences at the hands of the arm factions. They were robbed of their youth, their innocence and their hope for the future. They were also forced to become perpetrators of violence against other civilians. Looking at the status of Children before, since and after the war, focusing on some key areas were Children are affected, such as the Educational, Health, Economic, and Legal and socio-cultural spheres. The status of education in Sierra Leone before the war was unmistakably in decline. A number of factions including corruption, inadequate educational support for Children, unsafe environment for Children to go to school, the decline of the economy and the disarray in the teaching profession contributed to the decline in education. When the conflict broke-out, illiteracy in Sierra Leone was at all time higher of 88.75% for girls ands 69.3% for boys. Less than 45% of school going children ages entered primary school. Only 9% entered secondary school and 1% made it through to tertiary institutions. The struggle continues despite the role played by INGOs/NGOs/CBO and other charitable organizations providing support, but yet there is still much to be done looking at the present situation of Children in the country. Children are living under a market tables homelessly (Street Children), children without quality teachers especially in the provinces where for every 100 pupils in class you have one trained and qualify teacher, children are used to sell cool water, Ginger bear and Davita to support their parents at home instead of sending them to school, children are used as domestic tools to upkeep their Aunts/Uncles or family homes (Child Abuse/trafficking). The socio-cultural impact on children, children are abandoned, Orphaned, unaccompanied separated children, a situation which has resulted to a dramatic rise in the number of street children in the country. These children are mostly engage in commercial activities and petty crimes. Life for them on the street is unimaginably hard, continuously hazardous and prone to exploitation. The younger ones and the girls suffered from physical, sexual and psychological abuse. Children can be seen begging and hawking in the streets of Freetown and the provincial towns. Such activities, in the case of girls, create a pathway to involvement in other practices such as the sex trade. Life on the street can also lead children to engage in other forms of destructive behavior, such as drug and substance abuse, criminal activity and confrontation with law enforcement officials. The devastation of the economy has wipe out the earning and spending power of the average parents. As such children of school age were not able to attend school immediately after the conflict even where such areas were liberated; currently there are thousands of children who are still unable to attend school for a variety of reasons. The major state actors are the National Commission for Disarmament and Demobilization and Reintegration (NCDDR), The National Commission For War-Affected Children (NaCWAC), the Children Forum Network (CFN) and the Government, International Rescue Committee (IRC), and UNICEF. The impact of the conflict before, since and presently on the health of Children has even greater than that of adults because of the innate vulnerability of Children. Malnutrition was widespread and continues to be a problem because it contributes significantly to the high infant mortality rates in the country. Given the impact of the conflict on the economy, poor families are finding it very difficult to access health-care for themselves and their children. The war has affected both physical and psychosocial health of the children. Physically some children were injured during the war with guns, knives, axes and similar weapons. Of particular importance in this category are those children whop suffered mutilations at the hands of the war factions. Some of these children presently experience pain and other general discomfort to the extent that some of them need urgent help and for the rest of their lives. The psycho-social affects of the conflict have had a definitive impact on the children. Their experience has impacted negatively on their mind, leading to severe emotional and psychological suffering. The effects of their experience are far-reaching and long term and will require careful psycho-social support to help heal them. The overall development of children in Sierra Leone has been affected and will need major intervention if they are to take their rightful place in the world. The consequences of the systematic sexual violations that girls suffered in Sierra Leone including trauma, unwanted pregnancies and abortions, the contraction of delay diseases, physical and internal injuries, and miscarriages. In addition most girls have to face stigmatization in their communities. According to the only Psychiatrist in Sierra Leone, drug abuse in the country is out of control, to the point that he considers it a medical emergency. Children between the ages of 17 and 18 are worst affected. Drug abuse has affected most children in the country, whether directly or indirectly in an entirely negative way since, during and presently. Sierra Leone became member of the United Nations since 1961 and is a signatory to most of the Human Rights instrument. For example, the government of Sierra Leone has ratified the convention on the right of the child and the optional protocols. The government is obliged to take all appropriate legislatives, administrative, and other measures to ensure implementation of the right to recognize in the convention. The laws and customs relating to children are in urgent need of reform. As in many instances they are archaic and inconsistence and also not put in practice. Both law and custom relating to children are in conflict with international law on the right of the children particularly in their definition and understanding of when one is considered a child. For example, the children and young person act chapter 44 of the laws of Sierra Leone, the main legislation on children and juvenile justice, defines a child as a person of 14 years and under the age of 17years. Interpretation act no.8 of 1967 of the laws of Sierra Leone, act section 4 defines an infant as a person who has not attained the age of 21 years, and does not include cooperation. Under a customary law the age of majority is not fixed. It varies depending on the purpose for which it is considered and forms one ethnic group to another. Given a numerous definitions around what constitute a child, a great deal of uncertainty exist in law as to whether a particular law is applicable to children or not. This uncertainty affect the legal capacity of children both protection as children or be treated as adults. While provisions in the constitution provide a basic for the government to promote and advance the rights of children through its laws, policies and programmes, they have largely remained unused and ignored. Since the 1991 constitution came into effect, successive governments have paid little or no attention to addressing the welfare and interest of children in Sierra Leone. The dual legal systems exist before the conflict has impact negatively on the right of children. In many instances, both law and custom are in Clare contravention of international law, particularly the convention on the right of child. Traditional customs and practices have also exacerbated the position of children particularly the girl child. In an attempt to savage some of these issues, the My Own Children Network International Sierra Leone Chapter a Charitable non political community based Children organization, registered with the ministry of Social Welfare, Gender and Childrens Affairs has organize various communities, Social and cultural groups particularly disadvantage Children, (Orphan/Street Children /war Victim), Youths, stakeholders, women to promote the welfare of Children in Sierra Leone. It is against this background that the MOC Network International Canada Based programs have proposed to formally launch the organization in Freetown, Sierra Leone West Africa. AIMS AND OBJECTIVES The general aim of the launching is to create awareness about the existence of My Own Children Network International in Sierra Leone and it activities, and give it an official legal recognition and the right to function without humiliation. THE OBJECTIVIES INCLUDES: To collaborate with other Organizations with similar objectives/goals to promote development among children, volunteers, community groups and the nation at large.
